Anyone is allowed to start a company in Colombia, including foreigners, who have no restrictions to create either a local branch of a foreign company, or start a new company in Colombian territory. However, they are subject to national law in matters of registration, business incorporation and taxation.

In order to set up a legal entity or company, every person involved, regardless of nationality or residence status must be present at the time of signing the required documents. Alternatively, the person must have delegated sufficient legal power to a lawyer or other person via notarized letter, written in Spanish or translated by an official translator, authenticated and apostilled, or presented in front of a Colombian consulate.
